Nintendo won't brick 3DS' afterall?

 Joshua Gay of the Free Software Foundation claimed that Nintendo was able to brick any 3DS with a simple firmware update that's involved in any way with piracy. That statement went on to garner many mix feelings amongst the gaming community. Nintendo of The Netherlands has gone on to say:

 We did not take down any Nintendo 3DS systems. Some system updates for Nintendo 3DS contain functions to fight piracy, in which some functions will be disabled if the system has located an unauthorized device.

What do you think? It's definitely not quite as harsh of them if this is the case. However, it could also mean the same thing, albeit with less ruthless wording. One might also wonder the credibility of his statement as well, as usually it would be NOA or Nintendo of Japan that issues statements like this.
